James Alan McDonald was convicted of armed robbery (sec. 943.32 (1) (b) and (2), Stats.) of a Clark Service Station in Milwaukee on February 21, 1968. He was found guilty by a jury and sentenced by the court for an indeterminate term not exceeding four and one-half years. Prior to the trial McDonald made a pro se motion to suppress evidence of his identification in a police lineup. His appointed counsel (not his present counsel) did not accept the motion and did not want to pursue it so the court struck it from the record as a fugitive document. During the trial no contemporaneous objections were made by McDonalds counsel to the introduction of the identification evidence. At the end of the trial a motion was made for a judgment of acquittal or in the alternative to suppress the identification testimony on the grounds McDonald was denied counsel at the lineup and the in-court identification was based upon an illegal lineup identification. This motion was denied and subsequently post-conviction motions based on the same grounds were denied. The appeal is from the judgment of conviction and the order denying the motions.
